These Terms and Conditions govern your use of the Tongkang Bay website and the charter services we provide. By making an enquiry, submitting a booking, or using our vessel and crew, you indicate that you have read and accepted these terms. If anything is unclear, please contact us before proceeding — we are happy to explain any section.

1. Definitions

Throughout these Terms, the following words carry the meanings set out below:

2. Acceptance of Terms

By submitting an enquiry form, confirming a booking, or boarding our vessel, you agree to be bound by these Terms and Conditions in their entirety.

You confirm that you are at least 18 years of age and have the legal capacity to enter into this Agreement. Where a booking includes guests under 18, you accept responsibility for their conduct and compliance with all safety instructions.

If you are booking on behalf of a group, you take on responsibility for communicating these Terms to all members of that group and ensuring their agreement.

3. Service Description

Tongkang Bay provides yacht charter experiences operating from marinas in Singapore, including Sentosa Cove and ONE°15 Marina. Our offerings are as described on our website at the time of booking.

The captain reserves the right to adjust or modify the planned route, itinerary, or duration based on weather conditions, sea state, Maritime and Port Authority of Singapore (MPA) directives, or other circumstances affecting safe navigation. In such cases, we will endeavour to offer a comparable experience where possible.

Our services are available to residents and visitors in Singapore. Geographic or seasonal availability may vary.

4. Bookings & Payments

All bookings are subject to vessel availability and are only confirmed once a deposit has been received and a booking confirmation has been issued by Tongkang Bay.

5. Cancellation & Refunds

We understand that plans can change. Our cancellation policy is as follows:

Weather cancellations: If we determine that sea conditions are unsafe for departure, you may reschedule at no additional cost or receive a full refund of amounts paid. The captain's assessment of weather and sea conditions is final.

All cancellation requests must be submitted in writing to [email protected].

6. Guest Conduct

All guests are expected to conduct themselves in a manner that is respectful to the crew, other guests, and the marine environment. The following is not permitted aboard our vessels:

The captain retains the right to terminate a charter and return to port if any guest's behaviour poses a risk to safety or significantly disrupts the experience for others. In such circumstances, no refund will be issued.

7. Safety & Regulatory Compliance

All Tongkang Bay vessels are licensed and operated in compliance with requirements set by the Maritime and Port Authority of Singapore. Safety briefings are conducted at the commencement of every charter, and all guests are required to attend and follow the instructions provided.

Life jackets and safety equipment are available on board at all times. Guest cooperation with safety protocols is a condition of travel.

Guests with medical conditions that may be affected by sea travel are encouraged to seek independent medical advice before booking. Tongkang Bay is not liable for health-related incidents arising from undisclosed conditions.

8. Intellectual Property

All content on the Tongkang Bay website — including text, images, design elements, and branding — is the property of Tongkang Bay or its licensors. You may not reproduce, distribute, or use this content for commercial purposes without written permission.

Photographs taken by guests on board may be shared for personal, non-commercial use. Where Tongkang Bay photographs guests, we may use such images in promotional material unless you notify us otherwise in writing before departure.

9. Limitation of Liability

To the fullest extent permitted under Singapore law, Tongkang Bay's liability for any claim arising from a charter experience is limited to the total amount paid by you for that specific charter.

We are not liable for:

Nothing in these Terms limits liability for death, personal injury caused by negligence, or any other matter that cannot be excluded under applicable law.

10. Indemnification

You agree to indemnify and hold harmless Tongkang Bay, its employees, crew, and contractors from any claims, damages, fines, or costs arising from your breach of these Terms, your conduct while on board, or any misrepresentation you make in connection with a booking.

11. Termination

Tongkang Bay may cancel or decline a booking if there are reasonable grounds to believe that proceeding would compromise safety, violate regulations, or breach these Terms. In such cases, you will be notified and a refund will be issued on terms appropriate to the circumstances.

You may cancel a booking in accordance with the Cancellation Policy in Section 5. Early termination of a charter at sea due to guest misconduct does not entitle you to a refund.

12. Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Singapore. Any dispute arising from or in connection with these Terms or a charter booking shall be subject to the non-exclusive jurisdiction of the Singapore courts.

We encourage an informal resolution first. If you have a complaint or concern, please contact us at [email protected] and we will endeavour to respond within five business days.

Where informal resolution is not achieved, parties may seek mediation through the Singapore Mediation Centre before initiating formal court proceedings.
